These terms apply to your use of tracywise.com.au(the “website”) and to any orders or workshop bookings made through it. By using the website, you agree to these terms.
About us
The website is operated by Tracy Wise, an award winning, multidisciplinary Aboriginal artist, weaver and teacher of Barkindji, Ngiyampaa and Maligundidj (Wotjobaluk) heritage, currently living and working on Latji Latji Country. References to “we”, “us” and “our” mean Tracy Wise.
Using the website
You agree to use the website lawfully and not to:
- copy, scrape or republish content without permission;
- attempt to interfere with the website’s security, hosting or underlying systems;
- use the contact or order forms for spam, harassment, or any unlawful purpose.
Intellectual property
All artwork, photographs, designs, written content and other materials on this website are © Tracy Wise unless otherwise indicated. You may view the website and share links to it for personal, non‑commercial purposes. You may not reproduce, copy, modify, publish or sell any of the content without our written permission.
Cultural intellectual property
Tracy’s work draws on living Aboriginal cultural knowledge, stories and weaving practices. These belong collectively to her communities as well as individually to Tracy. Even where standard copyright law does not apply, the cultural rights and responsibilities connected to this work remain with Tracy and her communities.
Please respect this when engaging with the artwork: do not reproduce designs, stories or motifs without permission, and acknowledge their source if you share them.
Orders and shop
The shop on this website is run as an enquiry-based service:
- Placing an order is a request, not a confirmed purchase. Your order is not accepted until we reply to confirm it.
- We will contact you to confirm availability, the total price (including any shipping), and how to pay.
- Prices are shown in Australian dollars and may change without notice. The price that applies to your order is the one we confirm when we accept it.
- Many pieces are one of a kind. We do our best to keep stock accurate, but occasionally an item may already be sold by the time you order — if so, we’ll let you know straight away.
- Shipping is arranged after order confirmation. Timeframes depend on the destination and the item.
Workshops
Workshop enquiries made through the website are treated the same way as orders — a request until we confirm it with you. We’ll be in touch about availability, payment and what to bring. If a workshop is cancelled by us, we’ll offer you a refund or move your booking to a future date.
Returns and refunds
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Because most pieces are unique handmade works, please get in touchfirst if you have any concerns about a piece you’ve received — we want to make it right.
Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss arising out of your use of this website or the products and services offered through it. Nothing in these terms limits or excludes any rights you have under the Australian Consumer Law or other consumer protection legislation that cannot lawfully be limited or excluded.
